Terms & Conditions

By purchasing any items from www.oneillanimalart.com, or by commissioning a pet or any animal portrait from the artist you, the buyer, agree to all the terms detailed below.

COPYRIGHT:  

The Artist, Karen O’Neill, retains full copyright of the finished artwork. No prints or copies shall be made by you, or profit gained in any way from the finished artwork without my express written consent.  O’Neill Animal Art retains the right to use the image for advertising artistic services, through printed adverts (e.g. posters, flyers etc) and digital/social media (e.g. website, Facebook, Instagram).  O’Neill Animal Art retains the right to use the image on printed products (e.g. greetings cards, prints and other merchandise) where appropriate and with your permission. Clients who do not want their commissioned portrait to be shown online must notify me before work commences. If the client is happy with the artist using the commissioned work in this manner, but would like such use delayed for any reason, please let me know before commencement of the portrait or shortly thereafter and a suitable date can be agreed upon.

REFERENCE PHOTO: 

The photographs provided for reference images must have been taken by the client, or written permission for their use obtained by the client from the person who took them. This is to avoid any copyright claims being made against the artist. If the project is to be a gift, the client accepts responsibility for sourcing and using images that are of the recipient’s pet. If the commission is for any other animal i.e. a wild animal, again permission must be sought from the photographer, or the photograph to be sourced from a Royalty Free site such as Pixabay or bought by you from other such sites such as Adobe Stock or iStock. By sending me reference photos you grant me permission to use them in my publicity and advertising media (such as showing a comparison between the reference photo and the final artwork).

PORTRAIT GIFT CERTIFICATES:  

Certificates have a 1 year expiry date from purchase but are redeemed at the rates at the time of surrender. Pet portraits gift certificates are not exchangeable for cash but can be put towards a higher priced portrait commission provided the difference is paid. Prices start at £50.00

PAYMENT: 

I would require a non-refundable 50% deposit on acceptance of the commission to secure your place in my order book. Then, and only once you are happy with the finished portrait, the balance is to be paid and I will then send the portrait to you. If there are any problems or the artwork requires any changes, they must be stated BEFORE the item is posted out as once the piece is received by yourselves, postage costs to return the artwork back and forth to make further changes, will be your responsibility and costs will not be covered by Karen O’Neill herself.

Payment by instalments of one to three monthly payments can be arranged after the initial 50% deposit has been paid and cleared. This will need to be arranged before commencement of the portrait. The portrait will be delivered once all the balances have been paid. When the portrait is completed, you will be emailed a final version of the portrait for your approval. If you are not happy with this, and O’Neill Animal Art cannot resolve the issue with the artwork, you will not be required to make full payment and the portrait will remain the property of O’Neill Animal Art for either disposal, exhibition or portfolio. The deposit will be retained to cover materials, costs, loss of business and the time taken on the portrait so far. If you are local to me then I can deliver it, or if you prefer, we can make arrangements for you to collect it. Payment can be made by BACs or PayPal.

Please note that you cannot cancel the order after delivery and refunds are not available unless the item is damaged.

 

CANCELLATIONS:

You are under no obligation to pay the full amount until you are happy with the final result. If, for any reason, you want to cancel your commission before the final payment is made, you are free to do so at any time and will not need to pay any outstanding amount. I will, however, retain the deposit (and any amount already paid) to help cover loss of business, materials used and any time spent on the project so far. If you haven’t paid 30 days after notification of completion, and I have not heard otherwise, I will assume you want to cancel the commission. I will retain the right to add the cancelled commission for inclusion in my website and social media as an example of my work.

POSTAGE:

Portraits will be sent unframed and un-mounted, unless previously agreed. They will be securely flat packed and wrapped. All orders are sent insured to the sales value and with tracking to ensure a safe and timely delivery. They will be sent either via Royal Mail or a courier service. Every effort will be made to deliver your portrait on time, on or around the date stated by the Courier. However, it is not the responsibility of O’Neill Animal Art if your parcel is not delivered on time. In the unlikely event that your parcel is lost, a claim will be made for compensation against the total cost of your order. Should you receive your item damaged in any way, save your packaging and inform Karen O’Neill, providing as much photographic evidence of the damage to the artwork and the packaging as possible. The artwork should be sent back to Karen O'Neill unless otherwise stated and a repair or replacement will be completed at no additional cost to yourselves.
